-Measures against
doping
The fight
against doping in sport is necessary to adopt an approach of criminal policy on
the one hand, enhances the prohibited conduct research and improve the results
of the repressive measures against doping in sport, and that, moreover
providing appropriate punitive treatment to sanction the conduct of persons
belonging to the athlete involved or encourage doping and / or trafficking,
distribution and sale of banned substances environment. This approach demands
the introduction offense risk behaviors that are defined through an amendment
to the Criminal Code, and they can not be punished under the current
regulations.
Although
introduced the offense against public health in our legal system at present,
they are also listed as crimes against life and limb that include some of the
characteristics and behaviors of doping, to incorporate into criminal law
criminal types punish conduct not contemplated at this time, or are of dubious
inclusion, and provide for penalties applicable to few people or conducive environment
athlete involved in a case of doping, provided they are adjusted to the
principle of proportionality, addressing not only lack of consent in action but
also the scope of flawed consent of the athlete who is subjected to these
practices.
What do you think about sharapova´s doping? She consumed a substance to increase her endurance in the Open of Australia and that substance was forbidden when this year started. She consumed it years before when it was legal, is it unfair?
